DataDrivenAEC — Terms of Service


1. Acceptance of Terms

Plain English: By using our website or paying for a service, you’re agreeing to these terms. If you’re signing up on behalf of a firm, you’re saying you have the authority to do that. You need to be at least 16 to use the site, and 18 to purchase paid services.

By accessing or using datadrivenaec.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms, in which case “you” refers to that entity.

By using the Service, you confirm that you are at least 16 years old. To purchase paid services, you must be at least 18 years old or have the consent of a parent or legal guardian.

These Terms apply to all users, including visitors browsing free content and purchasers of paid agent services. The current version of these Terms is always available at datadrivenaec.com/terms.


2. Description of Service

Plain English: DataDrivenAEC is the AEC market-intelligence platform — plus three paid services where you upload project files and get back an AI-powered report. We keep it running as reliably as we can, but can’t guarantee 100% uptime.

DataDrivenAEC is the market-intelligence platform for the AEC industry — a live map of 20,000+ open opportunities worldwide, helping architecture and engineering firms find their next project first. The Service includes:

  • Free tools directory — a curated database of software tools, AI agents, and datasets for the architecture, engineering, and construction (AEC) industry
  • Free articles and newsletter — editorial content and a weekly email on AI in AEC
  • Paid agent services — AI-powered analysis including drawing review, opportunity research, and product research, which process files and project information you submit

The Service is primarily intended for professionals in the AEC industry. We do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features at any time, with notice where reasonably practicable.


3. User Accounts

Plain English: If you create an account, keep your password secure — you’re responsible for everything that happens under it. Use accurate information when signing up. If something looks wrong, tell us right away.

Certain features may require account registration. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Keep your password confidential and not share account access
  • Notify us immediately of any unauthorised access at [email protected]
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, or where false information was provided.


4. Paid Services

Plain English: When you pay for a drawing review, opportunity report, or product research brief, we start processing your files right away. Because of that, we don’t offer refunds once processing begins — but if something goes wrong on our end, we’ll make it right. Stripe handles payment; we never see your card number.

4.1 Services and Pricing

Current paid services:

  • Drawing Review — AI-powered code compliance review of construction drawing sets, priced per sheet
  • Opportunity Research (Opportunity Radar) — Research report on opportunities — competitions, RFPs, and upcoming projects — matching your firm’s profile, priced per report
  • Product Research — Curated research brief on AEC products for a specific project need, priced per brief

Prices are displayed at the time of purchase and are subject to change. Price changes do not apply to orders already placed and confirmed.

4.2 Payment Processing

Payments are processed by Stripe (stripe.com). By submitting payment information, you authorise the applicable charge. DataDrivenAEC does not store your card number or full payment details — these are handled entirely by Stripe and subject to Stripe’s Privacy Policy. Prices are displayed in the currency shown at checkout.

4.3 Taxes

Prices shown at checkout are final. Where tax treatment affects an invoice or receipt, it is stated on that document as required by law.

4.4 Refund Policy

Due to the nature of AI-powered research services, which begin processing immediately upon payment confirmation:

  • No refunds once file processing or research has begun
  • If we are unable to deliver a report due to a technical failure on our side, we will either re-process at no additional charge or issue a full refund, at our discretion
  • Disputes must be raised within 7 days of your purchase by contacting [email protected]

4.5 Delivery

Reports are delivered to the email address provided at checkout. Estimated delivery times are stated on each service page. These are estimates, not guarantees. We will notify you by email if a significant delay is expected.


5. File Uploads and User Content

Plain English: You own your drawings and project files — always. We use them only to run the analysis you paid for, then we delete them within 30 days. We never use your files to train AI models, and we don’t share them with anyone other than our AI processing provider (Anthropic) and our storage provider (Supabase/AWS).

5.1 Ownership

You retain all ownership rights to files and information you submit (“User Content”). By uploading User Content, you grant DataDrivenAEC a limited, non-exclusive, non-transferable licence to process and analyse that content solely for the purpose of delivering the service you purchased.

5.2 Permitted Uses of Your Files

We use your uploaded files exclusively to:

  • Run the AI analysis you paid for
  • Deliver your report
  • Investigate technical issues if you report a problem

We do not:

  • Use your files to train AI models
  • Share your files with third parties beyond the AI processing and storage providers acting on our behalf
  • Use your files for any purpose beyond delivering the service you purchased

5.3 AI Processing Disclosure

Your uploaded files are processed by Anthropic (Claude API) to generate your report. We operate under Anthropic’s API terms, which include a zero data retention policy — Anthropic does not use API inputs to train models and does not retain data after the request completes. See Anthropic’s Privacy Policy.

5.4 Your Responsibilities

You represent that:

  • You have the right to upload and share the files you submit
  • The files do not contain information you are prohibited from sharing (e.g., under NDA or confidentiality obligation) without appropriate authorisation
  • You will not upload files containing sensitive personal information of third parties beyond what is necessary for the analysis

5.5 Data Retention

Uploaded files are automatically deleted within 30 days of report delivery. You may request earlier deletion by emailing [email protected] and we will action it within 7 days.


6. Intellectual Property

Plain English: We own the website, the directory, and our brand. You own what you upload. Reports we generate for you are for your internal use — don’t resell them or republish them without asking us first.

DataDrivenAEC owns the Service, including its design, code, directory content, editorial content, and branding. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose.

Reports generated for you are licensed for your personal or internal business use only. You may not resell, redistribute, or publish reports (in whole or in substantial part) without our prior written permission.

You may not copy, scrape, or systematically extract directory data. See our robots.txt for crawling policies.


7. Prohibited Uses

Plain English: Don’t do anything illegal, harmful, or that would disrupt the service for others. Don’t scrape the directory. Don’t upload malware. Don’t try to reverse-engineer anything.

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Upload malware, viruses, or any harmful or disruptive code
  • Attempt to gain unauthorised access to any part of the Service or related systems
  • Scrape, bulk-download, or systematically extract data from the directory
  • Impersonate DataDrivenAEC or any other person or entity
  • Use the Service to generate content that infringes third-party intellectual property rights
  • Resell or commercially exploit any part of the Service without prior written permission
  • Use the Service in a way that could damage, disable, or impair its availability for other users

8. Privacy and Data Protection

Plain English: We take privacy seriously. Our full Privacy Policy is at /privacy, and our Security page at /security explains exactly what happens to files you upload. We’re GDPR-compliant, based in Berlin, and we never sell your data.

Your use of the Service is governed by our Privacy Policy and Security pages, which are incorporated into these Terms by reference.

GDPR: We are based in Berlin, Germany. The General Data Protection Regulation (GDPR) governs our processing of personal data. Your rights under GDPR are described in our Privacy Policy, including your rights to access, rectification, erasure, portability, and objection.

CCPA: If you are a California resident, the California Consumer Privacy Act (CCPA/CPRA) gives you additional rights described in our Privacy Policy, including the right to know what data we collect and the right to opt out of any sale of your data. We do not sell personal data.


9. Not Professional Advice

Plain English: Our AI reports are a tool to help you think and catch issues — not a replacement for a licensed professional. Don’t submit them to a building department or rely on them for a construction decision without having a qualified professional review them first.

The Service, including all AI-generated reports, is provided for informational purposes only. It does not constitute:

  • Professional architectural, engineering, or construction advice
  • Legal advice or legal compliance certification
  • A code compliance determination that can be relied upon for permitting, construction, or regulatory submissions

Always verify findings with a licensed architect, engineer, or other qualified professional before acting on any analysis provided by the Service.


10. Disclaimers

Plain English: We provide the Service as-is and do our best to keep it accurate and available — but we can’t make guarantees. AI-generated reports will sometimes miss things or get things wrong. Don’t hold us liable for circumstances outside our control.

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated reports will be complete or accurate.

Force Majeure: We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, acts of government, power failures, internet outages, or failures of third-party services (including AI model providers).


11. Limitation of Liability

Plain English: If something goes wrong, our liability is capped at what you paid us. We’re not on the hook for lost profits or indirect damages. Some jurisdictions don’t allow these caps, so they may not apply to you.

To the maximum extent permitted by applicable law, DataDrivenAEC’s total liability for any claim arising from your use of the Service shall not exceed the amount you paid for the specific service giving rise to the claim in the 12 months preceding the claim, or €100 for free-tier users.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data loss, or business interruption — even if we were advised of the possibility of such damages.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.


12. Indemnification

Plain English: If your use of the Service causes a legal claim against us — for example because you uploaded files you didn’t have the right to share — you agree to cover our legal costs.

You agree to defend, indemnify, and hold harmless DataDrivenAEC and its operators from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service in violation of these Terms
  • User Content you upload or submit
  • Your violation of any applicable law or third-party rights

We reserve the right to assume exclusive control of any matter subject to indemnification, in which case you agree to cooperate with us.


13. Termination

Plain English: You can stop using the Service any time. We can suspend your access if you’re violating these Terms. Either way, the sections covering IP, disclaimers, liability limits, and dispute resolution survive termination.

You may stop using the Service at any time. To delete your account and associated data, email [email protected].

We may suspend or terminate your access immediately, without prior notice, if you breach these Terms or if we reasonably believe continued access poses a risk. Where practical, we will give prior notice.

Upon termination, provisions that by their nature should survive — including intellectual property, not-professional-advice, disclaimers, limitation of liability, indemnification, and dispute resolution — shall continue to apply.


14. Dispute Resolution

Plain English: These Terms are governed by German law. If we have a dispute, let’s try to sort it out directly first. EU consumers can also use the EU’s online dispute resolution platform.

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law provisions. The UN Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first: If you have a dispute, contact us at [email protected]. We will attempt to resolve it informally within 30 days before either party pursues formal proceedings.

EU consumers: If you are an EU consumer, you may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Formal legal proceedings shall be brought in the courts of Berlin, Germany, subject to any mandatory consumer protection laws in your country of residence.


15. General Provisions

Plain English: Standard legal housekeeping. The short version: these Terms are the whole agreement, each section stands on its own, and we can transfer the business but you can’t transfer your account.

Entire Agreement: These Terms, together with our Privacy Policy and Security page, constitute the entire agreement between you and DataDrivenAEC regarding the Service and supersede all prior agreements.

Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable; all other provisions remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.

No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.

Electronic Communications: By using the Service, you consent to receiving communications from us electronically. These electronic communications satisfy any legal requirement that communications be in writing.


16. Changes to These Terms

Plain English: We may update these Terms. If the changes are material, we’ll update the date at the top and notify newsletter subscribers. Continuing to use the Service after changes means you accept them.

We may update these Terms from time to time. Material changes will be communicated by:

  • Updating the “Last Updated” date at the top of this page
  • Where appropriate, notifying newsletter subscribers by email

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
