Whole-life carbon rules by country: five national regimes and the EU overlay (2026)
Denmark limits new buildings above 1,000 m² to 12 kgCO₂e/m²/yr under BR18. France, the Netherlands, Sweden and Finland each use a different mechanism. EPBD 2024/1275 requires life-cycle GWP disclosure in the EPC from 2028 and 2030.
Denmark, France, the Netherlands, Sweden and Finland each regulate the carbon or environmental impact of new buildings, with five different mechanisms. Denmark applies a limit of 12 kgCO₂e/m²/yr to new buildings above 1,000 m² under BR18. Directive (EU) 2024/1275 (EPBD) Article 7(2) adds an EU-wide duty to disclose life-cycle global warming potential (GWP) in the energy performance certificate, from 2028 and 2030 (dates in EPBD 2028 architect requirements). The EPBD sets no EU limit.
What is a whole-life carbon rule, and which countries have one today?
A whole-life carbon rule requires a calculation, a declaration or a limit for the life-cycle greenhouse gas emissions of buildings. Scope varies: the rules draw on the modules of EN 15978 (A1 to A5 product and construction, B1 to B7 use, C1 to C4 end of life, D beyond the system boundary) but each cuts them differently. The table lists the regimes in outline; verify the current text with the competent national authority before relying on a value.
| Jurisdiction | Mechanism | Scope | Value or duty | Legal basis |
|---|---|---|---|---|
| Denmark | Limit | New buildings above 1,000 m² | 12 kgCO₂e/m²/yr over 50 years; stricter values phased in from July 2025 | Building Regulations (BR18), as amended |
| France | Regulatory maxima | New housing (from 1 January 2022), offices and primary and secondary schools (from 1 July 2022) | Icconstruction and Icénergie maxima, tightening to 2031 | RE2020 (Décret n° 2021-1004 and orders) |
| Netherlands | Limit on an environmental performance score | New housing; office buildings of 100 m² or more | 0.8 for housing, 1 for offices | Besluit bouwwerken leefomgeving (Bbl) |
| Sweden | Declaration | New buildings | Climate declaration (A1 to A5) registered with Boverket | Lag (2021:787) |
| Finland | Limit values | New buildings, with exceptions | Apply from 9 January 2026, set by use category | Building Act and ministry decree |
| EU | Disclosure in the EPC | Above 1,000 m² useful floor area from 2028; all new buildings from 2030 | Life-cycle GWP per Annex III, 50-year period | Directive (EU) 2024/1275, Art. 7(2) |
How do the regimes work?
Denmark. The BR18 calculation applies to buildings that need a building permit and uses a 50-year period. All new buildings above 1,000 m² must meet a limit of 12 kgCO₂e/m²/yr; a lower-carbon class at 8 kgCO₂e/m²/yr is voluntary. One Click LCA’s description of the BR18 calculation lists modules A1 to A3, B4, B6, C3, C4 and D as reported, with results per m² of heated floor area per year. The limit has been tightened and its scope widened from July 2025; check the current regulation for the value and building types that apply to your permit date.
France. RE2020 has applied to housing since 1 January 2022 and to offices and primary and secondary schools since 1 July 2022. It regulates Icconstruction (climate impact of construction products, equipment and their installation) and Icénergie (climate impact of the energy used over the building’s life), over a 50-year period, in kg CO₂e per m² of habitable or useful floor area. Icconstruction maxima tighten in steps. For collective housing, the average maximum is 740 kg CO₂e/m² for 2022 to 2024 and 490 from 2031; for offices 980 falling to 600; for primary and secondary schools 900 falling to 590. These are average values modulated by building-specific coefficients. Check the current decree before using a value in a design.
Netherlands. The Bbl, which replaced the Bouwbesluit 2012, sets an environmental performance requirement for housing and for office buildings of 100 m² or more (Bbl paragraph 4.4.2, table of limit values). The limit is 0.8 for housing and 1 for offices, calculated with the national determination method. The score is expressed as shadow costs; it is not a carbon figure.
Sweden. Lag (2021:787) requires a climate declaration for new buildings. Boverket’s page says only A1 to A5 data are reported in the declaration registered with Boverket, covering certain building parts including the climate shell and load-bearing structure. Boverket has proposed limit values for A1 to A5; verify whether they have been adopted.
Finland. Limit values for the carbon footprint of new buildings apply from 9 January 2026 to permit applications. The climate assessment and carbon footprint calculation must be completed by the final inspection. The limits are set by use category and tighten at the beginning of 2029. They do not apply to detached houses, defence buildings, buildings that need no energy certificate, or repairs and alterations that extend a building.
EU. Article 7(2) of the EPBD requires disclosure in the EPC, not a limit. Member States had to publish a roadmap for limit values by 1 January 2027. Annex III, as amended by Delegated Regulation (EU) 2026/52, sets the calculation framework: a 50-year reference study period, kg CO₂eq per m² of useful floor area, and a list of required and optional life-cycle stages. Transposition and dates are in EPBD 2028 architect requirements.

What calculation methods do the regimes use?
All of these rules build on life-cycle assessment following EN 15978, with product data from EPDs under EN 15804+A2 (see EN 15978 explained and what is an EPD). The national tools and datasets differ: Denmark’s calculation uses LCAbyg or another tool that supports the BR18 datasets, France’s uses the INIES database with the national method, and the Netherlands uses the national environmental database with the Bepalingsmethode Milieuprestatie Bouwwerken. Results from different national tools for the same building differ, so a calculation in one country’s tool does not demonstrate compliance in another. Level(s) indicator 1.2 is a voluntary EU reporting framework that the Commission’s Annex III work takes into account; see EU Level(s) framework.
Which other regimes exist outside national building codes?
London. The London Plan 2021, Policy SI 2 Part F, requires a whole life-cycle carbon assessment for referable applications, following the GLA’s March 2022 guidance and template. Assessments are encouraged for other major development.
California. The Buy Clean California Act (AB 262, signed 15 October 2017) applies to state procurement of structural steel, carbon steel rebar, flat glass and mineral wool board insulation. Department of General Services memos set maximum GWP values per material, and bidders submit EPDs. The requirements took effect in July 2022. The Act does not apply to private development.
Check the current position of any federal or national programme in the US, UK and other markets before citing it; several have changed recently.
Which compliance mistakes should you avoid?
-
Applying the wrong national calculation method. France’s RE2020 uses INIES data and its own method; Denmark’s BR18 uses its own datasets and module list. Submitting a result from a tool not set up for the national method does not satisfy the requirement.
-
Assuming “EU-wide” means uniform limits. The EPBD requires disclosure, not a uniform limit. A project that meets Denmark’s limit is not automatically compliant with the French maxima, which have a different scope and unit.
-
Treating procurement-only rules as universal. California’s Buy Clean Act applies to state procurement. Private projects there have no equivalent duty under it.
-
Underestimating the EPBD timeline. The transposition deadline was 29 May 2026. National transposition determines how the duty applies to your project, including any use of the Article 7(4) option not to apply the rules to buildings whose permit applications were submitted before the relevant date.
Frequently asked questions
What is Denmark’s whole-life carbon limit?
Under BR18, new buildings above 1,000 m² must meet 12 kgCO₂e/m²/yr, calculated over a 50-year period; a voluntary lower-carbon class is 8 kgCO₂e/m²/yr. Stricter values and a wider scope have been phased in from July 2025, so check the current regulation for the value that applies.
How does EU EPBD 2024/1275 affect building carbon disclosure?
It requires life-cycle GWP to be calculated and disclosed in the energy performance certificate, from 2028 and 2030; it sets no numeric limit and Member States may set limits. Dates and scope: EPBD 2028 architect requirements.
What is the Netherlands MPG, and what is the current limit?
MPG is the national environmental performance score used in the Bbl. The Bbl limit values are 0.8 for housing and 1 for office buildings of 100 m² or more. The score is based on shadow costs, not on carbon alone.
Which EU countries require a climate declaration?
Sweden requires one under Lag (2021:787), covering stages A1 to A5. Finland requires a climate assessment and carbon footprint calculation by final inspection, and has carbon footprint limit values from 9 January 2026.
Does the US have a whole-life carbon requirement for private buildings?
The Buy Clean California Act applies to state procurement of four material groups, not to private buildings. Check the current status of any federal programme and any state or city rule before assuming a requirement applies to a private project.
